    According to lawyer, Ly Nha Ky did not violate Vietnamese advertising law. The act of Ly Nha Ky sponsored for promotion of tourism and cinema of Vietnam is worth appreciation and encouragement.

      

    Recently, mass communications publicized information about Ly Nha Ky’s picture being displayed on billboard panel at Cannes Film Festival along with the slogan “Ly Nha Ky – The new voice” put aside promotional billboard panels of cinem and tourism of Ho Chi Minh City which stirred up the public. Particularly, at Cannes Film Festival 70th in France, Ly Nha Ky decided to sponsor 1 million euros to hang 3 grand billboard panels to promote tourism of Ho Chi Minh City and cinema of Vietnam.

     

    At the meeting between Ly Nha Ky and Ms. Ngo Phuong Lan – Head of Cinema Office, and Mr. Bui Ta Hoang Vu – Director of Tourism Department of Ho Chi Minh City before her trip to Cannes Film Festival in France, Ly Nha Ky announced about the promotional plan of cinema and tourism of Ho Chi Minh City. As a result, there are 3 promotional panels for Vietnamese cinema and Ho Chi Minh City tourism was hanged outside of  Barrìere Le Majestic Hotel. This position is facing the Palais des Festival where the red carpet activities of many international celebrities and film makers happens during Cannes Film Festival.

    Before the Opening Ceremony of Cannes Film Festival, when 3 promotional billboard panels of Vietnamese cinema and tourism were displayed, beside there is another 4th panel with picture of personal Ly Nha Ky along with the slogan “Ly Nha Ky – The new voice of Vietnam”, after that it was altered to “LY Nha Ky – The new voice”. Immediately there are controversial opinions.

     

    There are many opinions saying that Ly Nha Ky using her personal image for appearance on billboard panel of Cannes Film Festival along with the message “Ly Nha Ky – The new voice” is conflicting with law and regulation and it is a PR trick for herself. In order to know more about legal advice related to above issue, journalist had an interview with laywer Truong Quoc Hoe (Head of Interla Law Office – Bar Association of Hanoi).

     

    In your opinion, according the current law and regulation, the matter of Ly Nha Ky used her image on billboard panel in Cannes Film Festival along with slogan “Ly Nha Ky – The new voice” beside 3 promotional panels of cinema and tourism of Ho Chi Minh City at Cannes Film Festival is against law?

     

    -       In my opinion, Ly Nha Ky did not violate Vietnamese law and reguation, because:

    Before Ly Nha Ky went to Cannes Film Festival, she was together with Ms. Ngo Phuong Lan – Head of Cinema Office and Mr. Bui Ta Hoang Vu – Director o Ho Chi Minh City Tourism Department had a meeting with media in Ho Chi Minh City to publicize about Ly Nha Ky as an individual will sponsor for promotion of Vietnam image in Cannes. In reality, before Cannes Film Festival happens, promotional panels of tourism and cinema of Vietnam were hanged in the most prestigious position. There is 1 panel beside 3 promotional panels of tourism of Ho Chi Minh City and cinema of Vietnam with personal image of Ly Nha Ky along with slogan “Ly Nha Ky – The new voice”.

    Lawyer Truong Quoc Hoe asserted that Ly Nha Ky did not violate Advertising Law.

     

    Base on current law and regulation there is no rule about individual not allowed to promote personal image. Following point a term 1 of article 12 of Advertising Law 2012, advertiser has authority to advertise about organization, individual, product and service of their own. Hence, Ly Nha Ky advertises her personal image on billboard panel at Cannes Film Festival beside promotional panels of tourism of Ho Chi Minh City and cinema of Vietnam is not going against law and regulations.

     

    Besides, the exposure of personal image and the message “Ly Nha Ky – The new voice” on panel does not exist in banned activities in advertising according to Article 8 of Advertising law 2012. Hence, Ly Nha Ky advertises her personal image on billboard panel at Cannes Film Festival beside promotional panels of tourism of Ho Chi Minh City and cinema of Vietnam is not going against law and regulations.

     

    What is your opinion about this matter?

     

    -   To my point of view, the matter of an individual or organization to promote vastly country image and Vietnames people is worth appreciating and encouraging. Each individual has to be the ambassador of their country to introduce national beauty. On the big occasion of Cannes Film Festival, Ly Nha Ky spent a lot to sponsor for promotion of Ho Chi Minh City tourism and Vietnamese cinema, contributed significantly to deliver tourism image and cinema of our country closer to international friends.

     

    This act is supposed to receive support, not viciously attacked as such. Moreover, if this is Ly Nha Ky’s PR trick for her own also does not affect negatively image of tourism and cinema which she sponsors for promotion.
